Updated 8/14/23: This item was continued at the August 10th, 2023 Planning Commission meeting to allow the applicant to revise the request. On 8/14/23, the applicant withdrew the application. More specifically the applicant has revised the request eliminating the require to secure a Conditional Use Permit. A Building Permit for a detached garage that complies with code was issued on 5/9/23. Applicant has chosen to construct garage as approved by Building Permit #CIPB23-0863. The applicant has submitted a Conditional Use Permit to allow an oversized garage at 1706 Pevans Parkway. The property consists of 3.17 acres of land zoned Park Forest District that consists of a single-family structure. The existing house consist of 4,128 square feet with an attached garage of 984 square feet. The applicant is proposing to construct a 576 square-foot detached garage to the northwest of the existing single-family structure. The garage’s peak will reach 14.8 feet in height. The garage will not be used for commercial purposes or as a second residence. Chapter 17.04.315 of the Rapid City Municipal Code states that the maximum cumulative allowable size of all private garages shall be 1,500 square feet or 30% of the size of the gross floor area of the dwelling unit, whichever is greater. For this property, 1,500 square feet exceeds 30% of the gross floor area of the dwelling unit, therefore, all buildings dedicated to parking or storage which exceed a cumulative size of 1,500 square feet may only be allowed with the approval of a Conditional Use Permit. The 1,560 square-foot of garage space is 60 square feet over the maximum allowable size. The applicant has also submitted a Variance request to reduce the front yard setback from 20 feet to 10 feet for the proposed detached garage, City File#23VA011.
