The applicant has submitted a Conditional Use Permit to allow an oversized garage at 5500 Timberline Trail. The property consists of 17.23 acres of land zoned Low Density Residential District that consists of a single family structure, shed, and tennis court. The existing house consist of 5,120 square feet with an attached garage of 1,290 square feet. The applicant is proposing to renovate the existing attached garage into a wood shop area while building a newly attached 2,640 square-foot garage. The garage’s peak will reach 27 feet in height. The garage will not be used for commercial purposes or as a second residence. Chapter 17.04.315 of the Rapid City Municipal Code states that the maximum cumulative allowable size of all private garages shall be 1,500 square feet or 30% of the size of the gross floor area of the dwelling unit, whichever is greater. For this property, 1,500 square feet exceeds 30% of the gross floor area of the dwelling unit, therefore, all buildings dedicated to parking or storage which exceed a cumulative size of 1,500 square feet may only be allowed as a Conditional Use Permit. The 3,930 square-foot garage is 2,430 square feet over the maximum allowable size.
