Agenda Item Summary:
The subject property at 5900 West Highway 44, consists of 2.64 acres that are contiguous to the Rapid City Corporate limits. A Preliminary Subdivision Plan (23PL024) is being reviewed contemporaneously to split the property into two residential lots. Lot 1A is 1.37 acres, and Lot 2A is 1.27 acres. Chapter 16.04.090 requires that property adjacent to the City limits be annexed prior to submission of a Final Plat application. The City’s annexation policy sets forth goals through its annexation requirements to achieve orderly growth, the provision of urban services, health and safety measures, and an equitable tax base. Typically these goals are met for property adjacent to City limits, necessitating the annexation. The subject property is characterized by steep, wooded terrain which is accessed from SDDOT right-of-way at the intersection of 5900 W Highway 44 and Nameless Cave Road. The roads are currently graded and paved. Each proposed lot is developed with a single family structure with multiple accessory structures. The property is zoned Suburban Residential District in Pennington County. The City’s Future Land Use designation for this property is Forest Conservation. The property is located within the City’s Urban Services Boundary, The property will continue to utilize the existing well and Rapid Canyon Sewer service. Formerly, commercial uses on the property consisted of RV sales, storage, and a painting contractor’s business. Those uses have ceased and are not allowed in residential zoning districts in Pennington County or Rapid City. All permits for structures on the property have been secured through Pennington County. No illegal structures are present. This property is located within the Johnson Siding Volunteer Fire District. This Volunteer Fire Department has not certified any outstanding debt with the City of Rapid City that would enable payment from the City to the Fire District upon annexation pursuant to SDCL 34-31A-35 and Section 3.20 of the Rapid City Municipal Code. Once annexed, the property will be under the jurisdiction of the Rapid City Fire Department. Pennington County’s Future Land Use Plan designates this site as Low Density Residential. The existing use of the subject property does not hinder orderly growth, create health or safety issues, or an inequitable tax base. Once annexed, the property will be zoned No Use District and must be rezoned to Park Forest within 120 days.
