Agenda Item Summary:
This is an amendment to the ordinance being approved tonight. Since first reading of the original ordinance, Yankton is in the process of approving a similar ordinance which allows its Commission to approve additional restrictions via resolution. Based on the fact the spread of this disease is growing quickly both across the nation and in South Dakota and considering the nature of the restrictions that are being implemented by other states, counties, and cities to address the spread of this disease it seems likely that further action to address the spread of this disease will become necessary in the near future. The Governor has made clear that she believes the local governments have the authority to act and that it is their responsibility to adopt appropriate measures to slow the spread of this disease and to protect their citizens. The situation in South Dakota, the Black Hills, and Rapid City is changing daily. This ordinance amendment will allow you the flexibility to act quickly to address the current health emergency as the need arises.

Approve or Reject. If you reject the ordinance and later decide further restrictions or closures are needed, you will need to go through the normal ordinance process which will require at least 5 days between first and second reading. If you approve the amendment you can impose additional measures via a resolution that would go into effect upon publication, likely the next day. This change would avoid a 5 day delay for imposition of additional emergency measures that you have deemed to be necessary.
